Terms of Service

These terms cover using the shakthi.xyz website and the Mixva macOS app during its closed beta. Everything on this page is written to be understood on a single read, with legalese only where it’s load-bearing.


1. Acceptance

By using this site or the Mixva app, you agree to these terms and to the Privacy Policy. If you don’t agree, please don’t use the site or the app.

2. What’s covered

  • shakthi.xyz: the personal site, its articles, and the pillar pages under /technology, /music, /communities, and /photography.
  • Mixva beta: the macOS application you’ve been invited to install, together with the companion landing page at mixva.shakthi.xyz and the account + licence-token system that authorises it.

3. Beta disclaimer

Mixva is a work in progress. During the beta:

  • Features may change, be added, or be removed with little or no notice.
  • Bugs are expected. Please back up recordings you can’t afford to lose before running them through the app.
  • We don’t promise the service will always be available or that a given release will keep working. An update may require re-installing or re-signing in.
  • Feedback is welcome. Sharing bug reports, suggestions, or feature requests grants us the right to act on them without owing you compensation or attribution.

4. Your account & licence

A Mixva account is granted to you personally. Each installation registers a licence token bound to the device. You may install on the devices you personally use; don’t share your account credentials or licence tokens with others.

We can revoke a licence token or disable an account if we believe it’s been shared, compromised, or used to breach these terms. Revocation is server-side and takes effect on the next validation call.

5. What you may not do

  • Reverse-engineer, decompile, or attempt to extract source code from the Mixva app beyond what applicable law expressly permits (e.g. interoperability under §69e UrhG).
  • Use the site or the app to distribute malware, spam, harass anyone, or infringe copyright.
  • Circumvent authentication, rate limiting, or licence validation.
  • Resell, sublicense, or offer the Mixva app as a hosted service to third parties.

6. Content you upload

You keep ownership of the audio recordings and any associated metadata you process through Mixva. The desktop app processes them locally. Nothing you feed into it (source recordings, rendered WAVs, tracklists) is uploaded to our servers. See the Privacy Policy for the exact server-side data footprint.

7. Third-party services

Mixva uses Apple’s ShazamKit locally on your device to identify tracks. Apple’s terms apply to that use. We use Vercel for hosting, Turso for the database, and Google as an optional sign-in provider. Their terms apply to their portion of the service.

8. Termination

You can stop using the site or the app at any time and can request deletion of your account via hello@shakthi.xyz.

We can suspend or terminate access if you materially breach these terms, if the account has been inactive for an extended period, or if the beta itself ends. Where practical, we’ll give you notice before doing so.

9. Warranty & liability

The site and the app are provided “as is” during the beta, without warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent the law allows.

To the extent permitted by German law, our liability for damage is limited to intent and gross negligence, and, for essential contractual duties, to typically foreseeable damage. Liability under the German Product Liability Act (ProdHaftG) and for injury to life, body, or health is unaffected.

No fees are charged during the beta. Any monetary cap on liability is therefore zero for that period.

10. Changes to these terms

We can update these terms as the service evolves. The “Last updated” date at the top of this page always reflects the current version. Substantive changes that affect existing accounts will be announced by email or in-app before they take effect.

11. Governing law & venue

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for disputes with commercial users, legal entities under public law, or special public-law estates is Berlin. Mandatory consumer-protection venue rules for residents in other EU member states are unaffected.
